Courtroom tech failure stalls Sibiya bail hearing

Recording equipment fault interrupts Randburg bail proceedings

Bail proceedings for suspended Gauteng police deputy commissioner Shadrack Sibiya ground through the Randburg Magistrates’ Court on Thursday, with the State pressing concerns about possible witness intimidation and the courtroom itself briefly halted by a recording equipment failure.

Sibiya faces charges including rape, sexual grooming of a child, promotion of sexual grooming and human trafficking, and a further firearm-related charge has been added to the case. The application is being heard under Schedule 6 provisions, which places a higher burden on him to demonstrate why he should be released.

The State argued that some of the complainants may have felt intimidated because of Sibiya’s senior position within the police. Prosecutors have also raised the possibility that he could interfere with witnesses if granted bail, and have placed the issue of his alleged connections and influence before the court.

Evidence presented included further material on communication between Sibiya and a 16-year-old complainant. A police witness walked the court through WhatsApp exchanges which the State says form part of its case against the suspended officer.

The defence disputes the State’s version of events and maintains that Sibiya intends to plead not guilty. Earlier in the proceedings, the State questioned Sibiya’s legal team about correspondence sent to the National Director of Public Prosecutions before his arrest. Advocate Rishaad Moosa, who represented Sibiya in that correspondence, rejected the suggestion that the defence had been attempting to help him avoid arrest. He told the court the communication was intended to demonstrate his client’s willingness to cooperate and to prevent a public spectacle around the arrest.

The defence has also argued that Sibiya did not attempt to flee despite allegedly becoming aware that authorities were investigating complaints against him before his arrest on September 21.

Meanwhile, attention turned to the circumstances surrounding the additional firearm charge. Sibiya’s legal team has questioned the timing of that charge, arguing it was introduced as part of what it described as a fishing expedition.

The practical logistics of the court did not escape the day’s proceedings. Technical problems with the recording equipment briefly interrupted the hearing, and the magistrate dealt with other bail matters while the fault was being fixed, a reminder of the operational realities that underpin the delivery of justice in the case.

Sibiya’s disciplinary proceedings have become a consideration in the bail application as well. He has been served with notices relating to an expedited disciplinary hearing, but the arrangements could depend on whether he is granted bail, tying the internal police process to the outcome of the court’s decision.

The matter returns to court on Friday, where the State’s concerns about intimidation and interference, and the defence’s responses to them, are expected to remain central to whether the suspended deputy commissioner walks out of custody or waits behind bars for the next stage of the process.
